Hi! The name's Joey but I go by J or Oli online. I'm an illustrator and 2D generalist with a diploma in Animation & Visual Effects. I enjoy dabbling in parts of the 2D medium, from illustrations & concept art to animation & storyboarding.I have a fascination with mythology & the psychological genre and an adoration for indie projects. General Terms
✦ By purchasing my services, you automatically agree to the following conditions.
✦ I reserve the right to refuse any request for any reason.
✦ I reserve the right to use commissioned works for self-promotion (e.g. Social media posts, promotions, etc.) If the client wishes for full confidentiality, they must inform me prior to payment.
Contact & Communication
✦ Inquiries and communication are to be made via VGen Messaging or email at [email protected].
✦ Clients may refer to Trello for working & waitlist status. The board is updated regularly and serves as a means of staying updated in between direct check-ins.
✦ It is the client's responsibility to keep me updated on any changes in contact information. If all information provided becomes unusable and the client can no longer be reached, the commission will be cancelled after 5 business days and is not eligible for a refund.
Client & Artist Expectations
What I request/require of the client:
✦ Visual references must be provided, all methods of doing so are accepted! (Google Drive, Toyhou.se, Email Attachment etc.)
✦ If the client wants the requested characters to have specific poses or expressions, please indicate so in the request. Relevant images (if applicable) are very appreciated.
✦ Mood boards, inspiration boards, and written descriptions are also welcomed as they help to convey the character's personality or essence of the scene.
✦ If there were any missing/no specifications provided for the aforementioned, it is up to the artist's interpretation to dictate the final result of the commission.What the client can expect from me:
✦ Willingness to draw characters of any body type, skin tone, species, etc. and depict the requested character(s) as closely as are intended within my stylization.
✦ Commitment to proper representation and active collaboration with the client in making the best effort to depict what is requested.
✦ The client is allowed to draw over or edit works-in-progress (WIPs) to better communicate the desired result.
✦ I will not imitate or replicate other artists' art styles or edit/augment other artists' works.
Payment, Fees & Refunds
Payment
✦ All prices are listed in USD and payments are processed through VGen's proposal system, PayPal or Kofi.
✦ 2 payment options are offered, upon payment please indicate which option you prefer:
-✦- 100% upfront
-✦- 50% upfront, 50% after sketch approval
✦ I will not start until I have received some form of payment
✦ Cryptocurrency is NOT an acceptable form of payment
✦ If the client owes future invoices due to partial payment but still wishes for the commission to be completed, they may notify me to pause their commission to recover. The commission may then be put on hold for an extended period of time. Health is important and should take priority :)Potential Additional Fees
✦ An extra complexity fee may be added depending on several factors, such as the amount of detail that needs to be drawn (complex and busy designs, amount of objects, etc.) and anything that affects the difficulty and time spent on a commissioned work.✦ Major revisions (composition/pose changes, etc.) are only permitted during the initial drafting phase (conceptualizing stage, or sketching phase). Once the client approves this stage and the overall direction is established, only minor adjustments may be made afterwards without fee. Any excessive or arbitrary changes will incur additional fees relative to the time spent on said changes.✦ By default, there is no set deadline for commissioned works, if the commission is needed before a certain time, please inform me when requesting my services.
✦ Various factors affect the rush delivery fee, such as:
-✦- The type of request (how long it will take to complete before the deadline)
-✦- Current waitlist, queue, and workload (how much must be put aside to meet the deadline)
-✦- Any factors that may affect my ability to work within the deadline's requirements.
✦ Rush delivery fees can range anywhere from 10-50%Refunds & Cancellations
✦ Full refunds are only permitted if no progress has been made upon request.✦ The client may cancel a commission, provided that it is within reason, likewise, I also reserve the right to cancel a commission that is within reason.
✦ Upon cancellation, the client will receive the unfinished work and will be refunded an amount equivalent to the amount of work done.
✦ The client is only eligible for a refund if less than 50% of the work has been completed. If a cancellation occurs after this threshold, the client may still receive the unfinished work, however, no refunds will be given.
Usage & Rights
Personal Use
✦ By default, all commissioned works are considered for personal use.
✦ The work may be used in whatever way the client sees fit, given that it is not used to directly or indirectly make a profit.
✦ The client may also publicly post and share their commission, as long as credit is given.✦ Examples of personal use may include:
-✦- Printings intended to be kept personally or given as gifts
-✦- Icons/banners/wallpapers/etc. for personal accounts (NOT company/business accounts)
-✦- Reposting and sharing on social media, character archives, etc.Commercial Use
✦ Intention of using the commissioned work for profit will result in the addition of a commercial use fee where the cost is determined by its intended use- for example, producing merchandising rights would cost significantly more than a subscriber emote, etc.
✦ The commissioned work(s) may only be used within the limitations outlined by the agreed-upon terms.✦ Examples of commercial usage may be:
-✦- Reproducing and redistributing the work for profit (such as merchandising)
-✦- Usage in branding, promotional material, content, and website (including icon/banner/etc. usage, for company and business accounts),
-✦- Usage within mediums/platforms where the client receives profit (eg. Patreon, Twitch, YouTube, etc.The following terms are to be abided by, failure to comply will result in immediate blacklisting:
✦ Clients will refrain from claiming ownership of any commissioned work.
✦ Clients are never permitted, under any circumstances, to use any part of their commission for AI image generations/training, non-fungible tokens (NFTs) or used as advertising for the aforementioned. If such work is found listed as an NFT or resold for cryptocurrency, it is considered a direct violation of these terms and will be considered stolen.
✦ Intentional chargebacks with no prior notification are considered a method of abuse and exploitation and are therefore prohibited. If the client wishes to request a cancellation or refund, they must contact me first.
Process
Vgen
Commissions can be requested via VGen, a marketplace created for artists and clients to manage and showcase commission services.✦ To make a request, visit my VGen page and click on the 'Start request' or 'Join waitlist' button of the desired commission type. You'll be prompted to read the listing's information and terms of service which you'll be required to accept before filling out a form detailing your request.
✦ A proposal will be sent within 3 business days, detailing the price along with the subsequent fees, as well as other relevant information.
✦ If the proposal is not to the client's expectation, they are free to decline it. If a client has not responded with any update or payment within 3 days after an invoice is sent, the slot may be subject to forfeit and thus cancelled.✦ Once the client accepts the proposal and pays the invoice, work will begin where it will be marked as a WIP and the client will be notified.✦ The client will receive draft(s) and works in progress (WIPs) as needed and will continue to be shared throughout the commissioning process, where the client may request changes as work is being done to avoid later revision fees.
✦ If, at any point, the commissioned work requires correction, please inform me as soon as possible.✦ Once the commission is completed, approved, and final payment is received (if not previously taken care of), the final piece will be sent to the client in full through VGen, email and/or the client's preferred method.
✦ It is the client's responsibility to save any information, images, and other digital media that were delivered. All commissioned work will be saved and archived, but cannot be guaranteed against unforeseen circumstances such as computer failure or accidental deletion or loss in the future.
